Abstract

Abstract: This article addresses the social and political context that existed in Guatemala at the time of the creation of the first state constitution in 1825. It presents the political and legal foundations contained within the norm. The order of analysis is as follows: development of the rights that the constitution granted to citizens; analysis of the characteristics of the State presented by the constitution; presentation of the institutions that were created through the state constitutional text, highlighting their functions, integration, and comparison with current institutions. Since the 1825 Constitution was the first exercise of constitutional law in the national territory, a relationship between Guatemalan constitutionalism of 1825 and current constitutionalism is presented. This treatise is relevant because it presents the genesis of Guatemalan constitutionalism, and as such, this is the norm that gave rise to the Guatemalan constitutional State.
